1. Parties
This Distance Sales Agreement is concluded between:
SELLER:
Kismet Göreme Turizm Seyahat Acentası
BUYER:
The person who purchases a service via the website, online platforms, or digital communication channels.
By accepting this agreement, the BUYER agrees to pay the total amount of the booked service and any additional applicable fees.
2. Definitions
In this agreement:
Service: Any travel-related service (tours, balloon flights, transfers, activities)
Seller: Kismet Göreme Travel
Buyer: The customer purchasing the service
Site: The official website or digital sales channels
Parties: Buyer and Seller

3. Subject of the Agreement
This agreement regulates the rights and obligations of the parties in accordance with:

It applies to all services booked electronically.
Prices listed are valid at the time of booking and may change until confirmed.
4. Service Information
The details of the service (type, duration, inclusions, price) are presented:

Final details are confirmed at the time of reservation.

7. General Provisions
7.1 Information & Acceptance
The BUYER confirms that they have read and accepted:

Payment terms
Cancellation conditions
7.2 Nature of Services
Kismet Göreme Travel may:
Provide services directly
Work with selected local partners
Some services (e.g. balloon flights, tours) are operated by third-party suppliers.
7.3 Service Delivery
Services are provided on the agreed date, time, and location.
Guests must:
Be ready on time
Follow instructions
Failure to attend may result in loss of service without refund.
7.4 Impossibility of Service
If a service cannot be provided due to:
Weather
Operational issues
Force majeure
The BUYER may:
Accept an alternative
Reschedule
Request a refund
7.5 Payment Obligation
If payment is not completed:
The reservation is not confirmed
The SELLER has no obligation to provide the service
7.6 Credit Card Security
If unauthorized use of a card is detected:
The SELLER may cancel the booking

The SELLER may contact the BUYER via:

for booking and operational purposes.
7.8 Website Usage
The BUYER agrees:
Not to misuse the website
Not to engage in unlawful activities
8. Right of Withdrawal
For tourism services:
The right of withdrawal applies only before the service starts
Once the service has begun, withdrawal is not applicable
Last-minute bookings may not be eligible for cancellation.
9. Cancellation & Refund
Cancellation terms vary depending on the service and are defined in the Cancellation Policy.
Balloon flights → weather dependent
Tours → generally 24h free cancellation
No-shows → non-refundable
10. Liability
The SELLER:
Acts with reasonable care
Selects reliable partners
However, is not responsible for:
Third-party providers
Delays or cancellations
Accidents or injuries
All activities are undertaken at the BUYER’s own risk.
11. Dispute Resolution
In case of dispute:
Turkish Consumer Law applies
Consumer Arbitration Committees or Courts have jurisdiction
12. Enforcement
By completing the booking and payment, the BUYER confirms acceptance of this agreement.
